This Privacy Statement (“Statement”) serves to describe how we, Brooks Automation, Inc., collect, use and transfer information about you, through www.brooks.com and other websites that we operate and that include a direct link to this Statement (collectively, the “Sites”).
Information Collection and Use
Information from visitors to our web site is collected from both active submissions and passive browsing sessions. We will not share or sell the information collected with any third party in any way that is not described in this Policy. For some of the services that we provide through our web site we will ask you to register via an on-line registration form. In these cases, we may ask for both individual and company user information. For example, you may be asked to provide your name, organization, address, email address, phone number, fax number, a user identification and password. You may also elect to obtain products or services through our web site and you will be asked to provide information necessary to proceed with the transaction, such as shipping addresses and payment procedures. Additionally, you may submit information to apply for employment. We use this information principally to determine whether we have a position to which you are well-suited. If you become a Brooks’ employee the information that you submit can be used by Brooks as part of our employment records for use as such. In all the above cases, you will know what data is collected because you will actively submit it for the purpose described at the point of collection. We discourage the sending of sensitive information and any such information sent to us is sent at your own risk.
Sharing of Information
We will not disclose your personal information to third parties except (a) with your consent; (b) to our subsidiaries, affiliates and service providers to fulfill services or order requests, or otherwise to fulfill a contractual obligation to you; (c) to service providers who act on our behalf and under our instructions to perform certain functions; (d) on a “need to know” basis to meet stated legitimate business purposes; (e) as required by applicable law; (f) if required by court order or subpoena; (g) to public authorities to protect you, us, or third parties from harm; or (h) to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of Brooks’ assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding.
Transfers of Information
Third-parties receiving such information will be required to sign processing agreements and/or confidentiality agreements whereby they will commit to only process the personal information received consistent with the contracted purposes and shall be required to apply appropriate technical and organizational safeguards.
Brooks hosts and stores personal information in databases in locations throughout the world, but primarily in the United States. Brooks also hosts personal information through vendor platforms hosted on an internet cloud. Brooks has measures in place to ensure that adequate protection is provided to such data where legally mandated. Brooks has executed Standard Contractual Clauses to transfer personal information from the European Economic Area.
Information Protection and Security
Brooks ensures that commercially reasonable technical, physical, and administrative measures are in place to protect any information you provide to us from unauthorized access, loss or misuse. Nevertheless, please recognize that despite the precautions that we take no computer system or transmission of information can ever be completely secure or error-free and you should not expect that your information will remain private under all circumstances. Brooks’ Sites may contain links to websites outside of Brooks. Linked websites are not under our control or endorsed by us and we recommend that you review the privacy policies of such sites before using them.
Retention and Access
Brooks retains data at least as long as required by applicable law, and we may keep data as long as permitted by applicable law. You may access, correct, or update your information by accessing your accounts or profiles on our sites. You may at any time request access to a summary of information we hold about you by contacting us at email@example.com. We will make reasonable efforts to respond promptly to any requests to correct, update, or delete your information.

We reserve the right to change this Statement in our sole discretion. Changes will be noted by indicating the date the Statement was last updated.
